Bosch Files Patent Infringement and False Advertising Suit

BROADVIEW, Ill. – Robert Bosch LLC has filed a lawsuit against Pylon Manufacturing Corp., alleging patent violations. The complaint, which was filed in the Federal Court in the District of Delaware, alleges that certain Pylon wiper blades sold under the Optimum, Radius, and Symphony brands violate Bosch’s U.S. Patent Nos. 6,292,974, 6,675,434, 6,944,905 and 6,978,512.

The complaint also alleges Pylon has made false statements in commerce about the origin of these blades, for example, stating Pylon’s “expertise … has inspired the development of a high performance, frameless all-weather wiper blade with many innovative features and benefits, including … Advanced Frameless Design … [and] Integrated High-Downforce Spoiler.” Bosch contends these statements are false and mislead the trade and/or public into believing the technology employed in the Optimum, Radius and Symphony products was developed by Pylon rather than Bosch. As such, these statements constitute false or misleading descriptions of fact that misrepresent the true nature, characteristics and qualities of these product lines.

Bosch is seeking an injunction against continued infringement and acts of false advertising and an award of damages.
