Auto Care Association Salutes Connecticut for Passage of Magnuson-Moss Legislation

The law specifically refers to the anti-tying provision of the act, informing the purchaser that, “The Magnuson-Moss Warranty Act … makes it illegal for motor vehicle manufacturers or dealers to void a motor vehicle warranty or deny coverage under the motor vehicle warranty simply because aftermarket or recycled parts were installed or used on the vehicle or simply because someone other than the dealer performed service on the vehicle.”

Auto-Care-Association-LogoThe Auto Care Association salutes the Connecticut legislature for passing State Bill S. 99, which mandates that at the time of the sale of a new motor vehicle, a new car dealer must deliver to the purchaser of the vehicle a printed explanation of the Magnuson-Moss Warranty Act.

The law specifically refers to the anti-tying provision of the act, informing the purchaser that, “The Magnuson-Moss Warranty Act … makes it illegal for motor vehicle manufacturers or dealers to void a motor vehicle warranty or deny coverage under the motor vehicle warranty simply because aftermarket or recycled parts were installed or used on the vehicle or simply because someone other than the dealer performed service on the vehicle.”

“By introducing this legislation with a simple, elegantly crafted sentence, Connecticut State Senator Rob Kane has done a tremendous service for the consumers in his state,” said Kathleen Schmatz, president and CEO, Auto Care Association. “While we are grateful that the Federal Trade Commission has recently tightened up some of the troubling ambiguities in the act, this bill adds some needed clarification for the consumer that the auto care industry has been seeking for many years. We hope this new law becomes model legislation for other states that desire to promote competition in the repair industry and ensure that their consumers are aware of their rights under federal warranty law. We applaud Senator Kane for the bill and Governor Dannel Malloy for signing it into law.”
