ASA Launches New Government Affairs Web Site

The Automotive Service Association (ASA) has launched a new Web site to help communicate with federal and state representatives about issues impacting the automotive repair industry. According to a press release issued yesterday, the new Web site will help ASA and its members “mobilize support or dissent for issues directly impacting the automotive repair industry on both federal and state levels.”

ASA, ASC-MI Testify at Michigan Senate Insurance Committee Hearing on Insurer-Owned Repair

The Automotive Service Association (ASA) and the Automotive Service Councils of Michigan (ASC-MI) testified recently before the Michigan Senate Banking and Financial Institutions Committee on Senate Bill 819, Insurer Owned Repair legislation. Repair facility owners from throughout Michigan packed a Senate hearing room to show support for the legislation, according to ASA. The legislation prohibits insurance companies from owning or acquiring a repair facility in the state of Michigan. If the legislation is passed, any insurer that has ownership of a repair facility must divest itself of that facility within two years of the effective date of the legislation. S. 819 was introduced by Sen. Laura Toy, R-Livonia. The bill has 16 co-sponsors.

AAIA Issues ‘Call to Action’

On Feb. 26, Sen. Lindsey Graham, (R-S.C.), introduced the Motor Vehicle Owners’ Right to Repair legislation (S. 2138) in the Senate. Similar to legislation in the House (H.R. 2735), the bill would ensure that motorists retain the right to choose how and by whom their vehicles are maintained and repaired. AAIA and AWDA are strongly urging individuals and businesses involved in the industry to go to the Legislative Action Center at www.aftermarket.org and send a letter urging their senator to join Graham in supporting S. 2138.

Congressional Support for Right to Repair Act Growing

Momentum is building on Capitol Hill for the Motor Vehicle Owners’ Right to Repair Act. A total of 80 Congressman have signed on as sponsors to HR 2735, according to AAIA. Among the growing number of sponsors lining up behind sponsors Reps. Joe Barton (R-Texas), and Edolphus Towns (D-NY), are 13 members of The House Committee on Energy and Commerce. Consideration by this committee will be a critical first stop toward obtaining enactment.

Asbestos Bill Headed for Showdown

Senate Judiciary Committee Chairman Orrin Hatch (R-Utah), has acknowledged that asbestos litigation reform legislation (S1125) as currently drafted is unlikely to gain the necessary 60 votes required to end debate in the Senate. The legislation is a priority of Majority Leader Bill Frist (R-Tenn.), and he is working with high-ranking Democrats in an attempt to develop a compromise bill that will draw the necessary votes to overcome the expected filibuster. Key to the discussion is the amount of money contained in a trust fund to pay claims as well as the size of individual claims.

Delphi Says Law Will Affect Payouts

Delphi has said the Medicare prescription-drug law passed last month may reduce the company’s future payouts for retiree health-care coverage by $454 million. The company’s obligation at the end of 2003 would have been $8.02 billion with the legislation, or five percent less than $8.47 billion reported, Delphi said in an annual regulatory filing.

Taking Action on AHPs

The Association Health Plan (AHP) Coalition, made up of more than 150 associations including AAIA, is getting geared up for its second session. In order to raise the visibility of Association Health Plans in the Senate, a letter was sent to Senate Majority Leader Bill Frist (R-Tenn.), copying members of the Senate Uninsured Taskforce, asking him to include AHPs in any uninsured legislation he introduces.

Aftermarket Legislative Advocate Passes Away

A long-time friend of the aftermarket, Jack Heyler, died on Dec. 26, 2003 after a six-year battle with emphysema. Heyler was a tireless worker in support of the independent aftermarket, leading industry efforts to defeat legislation that would have extended state mandated emissions warranties to 10 years/100,000 miles; and to obtain passage of SB 1146, which mandated that car companies make emissions-related service information and diagnostic tools available to the independent service industry. He was active in the Automotive Service Counsels of California and the Society for Automotive Engineers, helping found the Service Technicians Society a SAE affiliate group.
