DENVER, Colo. — Gates Corp. has filed a lawsuit against Dorman Products Inc. in the United States District Court for the District of Colorado.
The lawsuit alleges that Dorman is engaged in false advertising and unfair competition based on Dorman’s advertising and sale of certain aftermarket automatic belt tensioners. Gates has requested a jury trial and seeks from the court a variety of remedies, including permanent injunctive relief, monetary damages, costs and attorneys’ fees.
The law firm of Merchant & Gould P.C. will represent Gates in this matter. George Matava will serve as the lead counsel.
Gates, part of the Industrial & Automotive group of Tomkins plc, is the second North American manufacturer of belts and hose to file suit against Dorman in recent weeks. Earlier this month, Dayco LLC announced a lawsuit against Dorman, alleging claims for trade dress infringement, false advertising and unfair competition based on Dorman’s sale of certain aftermarket automatic belt tensioners that are similar in appearance to corresponding Dayco products.
